This policy explains what personal information Create Your AI collects, why, and the choices you have. It covers our website, our work with clients, and the conversations our AI concierges handle for the businesses that hire us.
Who we are
Create Your AI LLC (“Create Your AI”, “we”) is a Florida limited liability company. You can reach us at hello@createyourai.co.
For Brazil’s General Data Protection Law (LGPD), we are the controller of the data described in sections 3 and 4, and our data protection officer (encarregado) answers at the same address.
Our two roles
When you visit our website or talk to us about our services, we decide how your information is used, so we are responsible for it.
When a shopper chats with a concierge we built for one of our clients, that client decides how the conversation is used. We process it on the client’s behalf as a service provider (an “operador” under the LGPD), under our Data Processing Addendum. Questions about those conversations are best sent to the business you were chatting with; we will help them answer.
What we collect
- Contact details you give us: name, email, phone or WhatsApp number, company, website and anything you write to us.
- Client account and billing information: billing contacts, company details, invoices and payment records. Card and bank details are handled by our payment processor; we don’t store full card numbers.
- What you send through our website: the contact form and the details you leave in the Ask panel. They are stored by our website host, Netlify, and delivered to our inbox.
- Questions you type to the assistant on our website (the Ask panel and the sample stores). See The assistant on this website.
- Technical information when you visit the site: IP address, browser, device and pages requested, kept in standard server logs.
We don’t use advertising cookies and we don’t sell your information. See our cookie policy.
How we use it
- To answer you and prepare demos (steps you asked for before a contract, and our legitimate interests).
- To provide, support and bill for our services (performance of a contract).
- To keep the website and services secure and working (legitimate interests).
- To meet legal, tax and accounting duties (legal obligation).
- To send business contacts occasional news about our services, with an opt-out in every message (legitimate interests or consent, as the law requires).
Conversations on our clients’ sites
Our concierges process what shoppers type: questions, product interests and, if the shopper chooses, contact details for a hand-off to the business. We use this only to provide the service to that client, to keep it secure and to fix and improve that client’s concierge.
We don’t sell it, we don’t use it for our own marketing, and we never use one client’s conversations for another client. Concierges say they are AI assistants, avoid asking for sensitive information, and send anything that needs a person to the client’s team.
The assistant on this website
The Ask panel and the sample stores on this website run on the same kind of AI we build for clients. It is an AI assistant, not a person, and it answers only about Create Your AI and the sample stores.
To write each answer, what you type, with the earlier messages of that conversation, is sent to our AI model provider, Anthropic. We don’t save these conversations on our servers or use them to train models, and our provider’s business terms don’t allow it to train its models on them; it may keep them for a limited time under those terms, for example to detect misuse. The conversation stays in your browser tab until you close it or press Clear chat. Please don’t type sensitive information in the chat.
If you choose to leave your name, email, company or WhatsApp number, we use them only to answer you and to follow up on what you asked for.
AI models
Our concierges use large language models from third-party providers to understand questions and write answers. Conversation text is sent to them only to produce the answer. We choose providers whose business terms don’t allow them to train their models on our clients’ data, and we don’t train models on it either. Current providers are listed in our Data Processing Addendum.
International transfers
We are based in the United States, and some of our providers operate in the United States and other countries. When personal data from Brazil is transferred abroad, we rely on Article 33 of the LGPD, including the standard contractual clauses approved by Brazil’s data protection authority (ANPD) in Resolution CD/ANPD 19/2024, where they apply.
How long we keep it
- Sales conversations, including forms sent through our website: up to 2 years after our last contact.
- Conversations with the assistant on our website: not kept by us. They stay in your browser tab until you close it.
- Client account and billing records: for the contract, then as long as tax and accounting laws require, usually 5 to 7 years.
- Server logs: up to 90 days, unless needed to investigate a security issue.
- Concierge conversations: as set in the client’s contract, then returned or deleted within 30 days after it ends.
Security
We use encryption in transit, limit access to the people who need it, require multi-factor sign-in on our systems and review the providers we use. No system is perfectly secure. If a breach affects your information, we will tell you and the authorities as the law requires.
Your rights
Everyone
You can ask what information we have about you, ask us to correct or delete it, and stop our news at any time.
In Brazil (LGPD)
You have the rights in Article 18 of the LGPD: confirmation that we process your data; access; correction; anonymization, blocking or deletion of unnecessary or excessive data; portability; deletion of data processed with your consent; information about who we share it with and about refusing consent; and withdrawal of consent. You may also complain to the ANPD at gov.br/anpd.
In the United States
Depending on where you live (for example California, Colorado, Connecticut, Texas or Virginia), you may have the right to know, access, correct and delete your personal information, to get a portable copy, and to opt out of its sale, of targeted advertising and of certain profiling. We don’t sell personal information or use it for targeted advertising. We won’t treat you differently for using your rights. You may use an authorized agent, and you may appeal our decision by replying to it.
How to ask
Email hello@createyourai.co. We may need to confirm who you are. We answer within the time the law sets: 15 days under the LGPD and 45 days under most US state laws. If your request is about a conversation on one of our clients’ sites, we pass it to that client and help them answer.
Children
Our website and services are for businesses. We don’t knowingly collect information from children under 13, or under 16 where the law sets that age. Concierges are made for adult customers, and clients may not aim them at children.
Changes to this policy
We post any change here with a new date. If a change is significant, we tell clients and the people we are in contact with before it takes effect.
